1. Introduction

These Terms and Conditions ("Terms") govern your use of the IPAfricaTV IPTV streaming service ("Service") provided by IPAFRICA TV GH LTD ("Company", "we", "us", "our"), a licensed IPTV operator registered in Ghana. By subscribing to our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

By clicking "I agree to the Terms & Conditions" during the subscription process and proceeding with payment, you enter into a binding agreement with the Company.

2. Service Description

IPAfricaTV provides Internet Protocol Television (IPTV) streaming services, delivering television content over the internet. The Service includes access to live TV channels, on-demand content, and related streaming features as described on our website at ipafricatv.online.

The Service is accessible through compatible IPTV applications including but not limited to IPTV Smarters Pro, TiviMate, VLC Media Player, GSE Player, and OTT Navigator, on supported devices such as Android phones, tablets, Smart TVs, Amazon Firestick, iOS devices, and desktop computers.

3. Subscription Plans & Pricing

We offer the following subscription plans, payable in Ghana Cedis (GHS):

1 Month: GHS 90.00 | 3 Months: GHS 240.00 | 6 Months: GHS 420.00 | 12 Months: GHS 720.00

Prices are subject to change. Any price changes will apply to new subscriptions and renewals after the change date, not to active subscriptions.

4. Payment Terms

Payments are processed securely through First Atlantic Bank Ghana's DigiPay payment gateway. We accept Visa, MasterCard, and Mobile Money (MTN, Vodafone, AirtelTigo) payments.

All payments are processed in Ghana Cedis (GHS). By providing your payment information, you authorize us to charge the applicable subscription fee to your selected payment method.

Upon successful payment, your IPTV subscription will be activated automatically, and your login credentials will be displayed on screen and sent to your registered email address.

5. No Refund Policy

All payments are final and non-refundable. Once a subscription has been activated and credentials have been issued, no refunds will be provided under any circumstances, including but not limited to:

Change of mind after purchase; dissatisfaction with channel selection or content quality; failure to use the Service during the subscription period; inability to access the Service due to your internet connection, device compatibility, or third-party application issues; accidental or duplicate purchases.

We strongly recommend reviewing the available channels and Service features before subscribing. If you experience technical difficulties with the Service itself (not related to your internet or device), please contact our support team for assistance.

6. Account & Credential Usage

6.1 Personal Use Only

Your subscription credentials (username, password, and M3U URL) are for your personal use only. Each subscription is licensed for use on one (1) device at a time.

6.2 Account Sharing Restrictions

You may not share, distribute, sell, resell, sublicense, or otherwise make your credentials available to any third party. Sharing of account credentials is strictly prohibited and constitutes a violation of these Terms.

If we detect unauthorized sharing, simultaneous multi-device usage, or redistribution of your credentials, we reserve the right to immediately suspend or terminate your account without refund and without prior notice.

6.3 Credential Security

You are responsible for maintaining the confidentiality of your login credentials. You must not publicly post, share on social media, or distribute your credentials in any way. Any unauthorized use of your account is your responsibility.

7. Service Availability

7.1 Best Effort Service

We strive to provide continuous and uninterrupted access to the Service. However, the Service is provided on a "best effort" and "as available" basis. We do not guarantee 100% uptime or uninterrupted access.

7.2 Service Interruptions

The Service may be temporarily unavailable due to scheduled maintenance and system upgrades; technical issues with streaming servers or content delivery networks; internet connectivity issues beyond our control; force majeure events including but not limited to natural disasters, power outages, or government actions; third-party service provider outages.

7.3 Content Availability

Channel lineups and content availability may change from time to time without prior notice. We do not guarantee that specific channels or content will be available throughout your subscription period. Changes to content are at the discretion of content providers and are beyond our control.

7.4 No Compensation for Downtime

We shall not be liable for any compensation, refund, or extension of subscription due to temporary service interruptions or content changes, unless the interruption is caused solely by us and exceeds 72 consecutive hours.

8. Data Privacy & Protection

8.1 Information We Collect

When you subscribe, we collect your full name, email address, mobile phone number, and payment transaction details. This information is necessary to process your subscription, deliver your IPTV credentials, and provide customer support.

8.2 How We Use Your Data

Your personal data is used to process and activate your IPTV subscription; send you your login credentials and subscription confirmations; communicate important service updates and notifications; provide customer support; comply with legal and regulatory requirements.

8.3 Payment Data

Payment processing is handled by First Atlantic Bank Ghana. We do not store your credit card numbers, CVV codes, or Mobile Money PINs. All payment data is processed securely through the bank's PCI DSS compliant payment gateway.

8.4 Data Sharing

We do not sell, trade, or rent your personal information to third parties. Your data may be shared only with our payment processor (First Atlantic Bank) for transaction processing; our IPTV service providers for account activation; law enforcement or regulatory authorities when required by law.

8.5 Data Retention

We retain your personal data for as long as your subscription is active and for a reasonable period thereafter for record-keeping and legal compliance purposes.

8.6 Your Rights

You have the right to request access to, correction of, or deletion of your personal data by contacting us at sales@ipafricatv.online. Please note that deletion of account data may result in inability to verify your subscription history.

9. Acceptable Use

You agree not to use the Service for any unlawful purpose; record, redistribute, or retransmit any content from the Service; attempt to reverse engineer, modify, or tamper with the Service; use VPN or proxy services to circumvent geographic restrictions; use automated tools, bots, or scripts to access the Service.

Violation of these acceptable use terms may result in immediate account termination without refund.

10. Intellectual Property

All content delivered through the Service is protected by copyright and intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to view the content for personal, non-commercial use only.

11. Limitation of Liability

To the maximum extent permitted by law, IPAFRICA TV GH LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for your current subscription period.

12. Subscription Renewal

Subscriptions do not auto-renew. When your subscription expires, your access to the Service will cease. To continue using the Service, you must manually renew your subscription through our website. Renewal extends your existing account; no new credentials are issued unless requested.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach any of these Terms; your account is involved in credential sharing or unauthorized redistribution; we are required to do so by law or regulatory order.

Upon termination for breach, no refund will be provided for any remaining subscription period.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the revised date. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
